In a prepared decision, Justice John Mitchell says the store had early opening hours and Hogan was given keys to the store and was paid extra for the duty of opening the store.

Mitchell says Hogan began stealing various lottery tickets from her employer and when the stolen ticket turned out to be a winner she, her husband, or son cashed the ticket and used the money to pay off debts and other expenses.

The judge says neither Hogan’s husband nor her son were aware of the fact the tickets were stolen.
