Construction firm fires back in Winnipeg stadium legal battle

WINNIPEG – The legal battle over construction flaws at Investors Group Field continues to heat up.

Stuart Olson Dominion, the construction company that built the stadium, is being sued by the stadium’s owners, Triple B. The Bombers are a main tenant of the stadium.

Triple B claims there are several flaws with the stadium including some serious drainage issues. It claims those problems will cost just under $5 million to fix and wants Stuart Olson to foot that bill.

But, in a formal Statement of Defence filed in court Thursday, Stuart Olson says it stands behind its work and puts the blame back on Triple B, along with the provincial government.

Stuart Olson claims the plaintiff and the province “knowingly approved a design without regard for the problems that the plaintiff now pleads as being the responsibility of Stuart Olson.”

The statement of defence goes on to allege the stadium may have been rushed.

It states, “Throughout the course of the project, the plaintiff and its stakeholder, the Province of Manitoba, sought to complete the project in as fast a manner as possible.”

“The plaintiff and the Province of Manitoba made many decisions with respect to the construction and design of the field without fist adequately taking the time to consider many details, including, for example, what concessions would be installed, operational logistics reviews, media broadcast requirements, air structure feasibility, and winter use.”

Stuart Olson says any issues with the stadium are the responsibility of Triple B, through negligence. It claims Triple B failed to make correct decisions when it came to timeline, budget, design and location.

The claim alleges Stuart Olson wasn’t given as much time or as large a budget as it usually would be for a project this large.

None of the allegations from either side have been proven in court.
