Tim Bosma murder trial delayed until 2016

TORONTO – The trial of two men accused of killing Tim Bosma of Ancaster, Ont., has been push back until early next year.

Court documents obtained by the Hamilton Spectator indicate the original trial date of Sept. 28 was “vacated” and a new date set for Jan. 11, 2016.

According to the Spectator, the trial delay seems to be partly due to a longer window for pretrial motions, which will continue on April 30 and May 1 and carry on again Sept. 28.

Mark Smich and Dellen Millard, the two men accused of killing Bosma, made a court appearance in Hamilton this week during pretrial motions.

The public — including Bosma’s father Hank Bosma, members of Bosma’s family and the media — was banned from attending. But Hank’s friend Peter Lowe said he’s not surprised or upset by the decision to exclude the public.

“There’s not this huge fear that we don’t know what’s going on – we’ll just find out later,” Lowe said.

Bosma vanished on May 6, 2013 after leaving home in his pick-up truck with two men after posting an online ad to sell the vehicle.

The 32-year-old man’s remains were found about a week later, burned beyond recognition, at a southwestern Ontario farm belonging to Millard.

He and Smich have each been charged with first-degree murder.

Millard has additionally been charged with the murder of missing woman Laura Babcock and Millard’s father, Wayne Millard.

Police had originally deemed the father’s death a suicide in November 2012 but reopened the investigation after Dellen’s arrest in the Bosma case.

The three murder cases are being treated separately by police.
