Kelowna lawyer suspended for swearing in courthouse

KELOWNA, B.C. — Kelowna lawyer, Martin Johnson has been suspended after swearing at a potential trial witness in a courthouse, according to the Law Society of BC.

The society’s panel concluded that Johnson committed professional misconduct when he uttered a profanity to the witness, a police officer, in the corridor of the Kelowna courthouse.

Johnson was provoked by the witness according to the society.

“We do not consider there was likely any negative impact on the police officer. He did not testify and there was no evidence of any impact,” says the panel.

However, the society says lawyers are expected to conduct themselves with civility, dignity and restraint, adding Johnson’s behaviour cannot be excused.

He has been handed a 30-day suspension as well as a $10,503.05 fine.

The society’s panel originally sought a suspension of two months as well as a requirement that Johnson complete an anger management course.
