Joshua Berner has been sentenced to life in prison. The son of the woman convicted of killing four-year old Alexa Middelaer in a drinking and driving accident will not be able to apply for parole for 10 years.
Joshua Berner was convicted of stabbing a man to death in Richmond. The sentence is in line with what prosecutors had been asking for.
In October, a B.C. Supreme Court jury found Joshua Berner guilty of second-degree murder in the February 2009 fatal stabbing of Benjamin Warland, 23, near a Richmond bus stop.
Berner, 27, testified that the incident began when the two men had gotten off the bus near Cambie and Dallyn roads.
Warland followed Berner and a friend and approached the two men, punching Berner’s friend from behind, knocking him unconscious, before pulling a knife on Berner.
Berner and Warland then fought one another, with Berner getting the upper hand and stabbing Warland twice in the head with the knife. Berner suffered a stab wound to his thigh.
The jury found the accused guilty of murder but made no recommendation on parole ineligibility.
Berner’s mother, Carol-Ann Berner, was last week released on bail pending her appeal of a conviction in which her drunk driving caused the death of four-year-old Alexa Middelaer.
