PENTICTON – The City of Penticton is on the receiving end of a slip-and-fall lawsuit.
Glen Ronald Hudson says in January he fell on an icy sidewalk that parallels Okanagan Lake and suffered various injuries, including spinal fractures.
Hudson is suing the city claiming it is negligent in failing to apply anti-icing material to the sidewalk and allowing the hazard to persist.
He’s claiming unspecified damages for pain, suffering, loss of enjoyment of life and loss of homemaking capacity.
The city denies Hudson’s allegations, asserting he failed to exercise reasonable care and prudent judgment to ensure his own safety.
In it court-filed response, the city says: “Its employees, servants or agents acted on the basis of policy decisions that were bona fide and based on financial, economic, social or political factors or constraints (the Policy) and that the Policy was reasonable.”
The city also denies it owed Hudson any duty of care, and if it did, the city claims “it discharged such duty in a reasonable and competent manner.”
