Case of 19-year-old man accused in Edson triple homicide put over

The 19-year-old man charged with two counts of first-degree murder and one count of second-degree murder in the killing of three people last month did not appear at his first court appearance Tuesday.

Duty council appeared on behalf of Mickell Clayton Bailey in the provincial court in Edson at 10 a.m. He remains at Alberta Hospital.

Bailey is charged in the deaths of a man, woman and teenage girl found in a rural Alberta home near Edson Nov. 29. Roxanne Berube, her partner Dan Miller and her teenage daughter Jazmine Lyon were found dead.

Reading of the charges was waived and the plea reserved for Jan. 5, 2016.

Judge D.C. Norheim issued a no contact order for eight individuals.

Family members were in court for the proceedings Tuesday.

“This is a crime that has shocked local citizens, police, and all Albertans,” RCMP Supt. Gary Steinke said. “The murder of the three innocent victims in their own home is unsettling for even the most seasoned police investigator.”

RCMP said Bailey was the sole suspect. When they went to a property to arrest him, he was armed, officers said. The 19-year-old was shot and taken to an Edmonton hospital to be treated for serious injuries.

Edson is about 200 kilometres west of Edmonton.

The Alberta Serious Incident Response Team (ASIRT) is investigating the officer-involved shooting.

Officers said Bailey knew the three victims.

Family of Berube said the accused is her ex-husband’s nephew.

“I knew him since he was born. That’s why I can’t believe it,” said Berube’s cousin Chantell Sale.

She described Bailey as kind, quiet, a young man who spent a lot of time with his grandfather. Sale said she saw him just two months ago.

“It was always open arms, hugs… I always gave Mickell a hug.”
