HAMILTON – A Superior court judge has sentenced two Hamilton brothers to life in prison for what he called a “senseless” and “vigilante” style killing of a former Hells Angel in 2013.

The judge said gun violence can’t be tolerated as ruled it would be 13 years before John and Mato Josipovic would be eligible for parole.

The brothers were convicted of second-degree murder after James (Lou) Malone was gunned down at point blank range in the early morning hours of March 9, 2013 (on Kenilworth Avenue near Hope Avenue.)

Judge Harrison Arrell said the details surrounding Lou Malone’s “senseless and violent death” made him consider a sentence that would strongly condemn and deter acts of “vigilante justice.”

Family members of both defendants and the victim were in the Hamilton courtroom for the sentencing.

The Crown had sought 18 to 20 years before either brother would be eligible for parole. The defence countered saying 10 years would be most appropriate.
