KELOWNA – He did the crime but he won’t be doing any jail time.
Kelowna RCMP arrested a suspect in March after a female clerk at a downtown clothing store reported being rubbed against and groped by a male customer.
Police determined the incident could be related to two others that happened about the same time at retail stores along Highway 33 in Rutland.
The circumstances were almost identical.
Brian Edmund Spencer, 61, was charged with two counts of sexual assault.
However, the case won’t be prosecuted following a psychiatric examination.
A judge has ruled Spencer is not criminally responsible because of a mental disorder.
