12-year-old Montreal boy accused of shooting older brother allegedly used grandfather’s gun

MONTREAL — The gun used by a 12-year-old boy accused of shooting his older brother in January belonged to the boys’ deceased grandfather.

Montreal police Sgt.-Det. Steve Abraham told Quebec Youth Court Thursday that the boys had recently expressed having their grandfather’s two rifles and three shotguns as a keepsake of the man, who passed away in 2006.

The grandmother handed them over in December but when the parents disagreed with the move, the weapons were returned.

Except, the detective said, the younger boy secretly withheld a handgun from the gun collection, hid it in his closet, then used it to shoot his brother.

He said the gun had been seen by other youths outside of the accused’s home and had also been used in an armed robbery Jan. 2.

On Jan. 21, the day of the shooting in Dorval, Kevin Dvork, 18, was also at the home and gave police a different version of events than the accused, who claimed it was an accident, Abraham said.

The accused can’t be named because he is a minor.

He is charged with manslaughter and possession of a prohibited weapon.
