Appeal denied for couple who killed senior for his truck

 CALGARY- The family of a Calgary senior who was brutally murdered so a couple could steal his truck is finally getting some form of closure.

Four years ago, 77-year-old Ray Johnson, a flea market vendor, was lured to a home in Bridgeland and killed.

Jason Hubler, 36, and his wife Tosha, 31, were found guilty of first-degree murder in the case, but appealed their conviction.

“It just felt a bit unfair that our family had to go through more after going through the trial,” says Bonnie Gillard, Johnson’s daughter. “We just felt like it should be over, that should be the end of things.”

On Friday, a panel of appeal judges turned the couple’s appeal down, stating:

“The case against Jason was overwhelming…The grounds of appeal raised by Jason are without merit…Jason’s appeal is therefore dismissed.

In this case the evidence was so overwhelming against Tosha, as it was against Jason, that a conviction was inevitable. There is no realistic possibility that a new trial would yield a different result.”

Johnson’s family is relieved at the outcome, but worry they’ll never find peace.

“It’s been four years of sleepless nights,” says Gillard. “It just felt like it goes on and on and on, seems like it’s never over.

“It just seems like it destroys your life and never stops.”

Johnson’s family say they’re committed to making sure the killers stay behind bars.
