The Saskatchewan Court of Appeal will hear arguments in February on whether the election results of a First Nation northeast of Regina should stand.
In October, a Regina judge threw out the results of an election on the George Gordon First Nation due to voting irregularities.
Lawyers for the ousted chief and council want that decision overturned, arguing the judge did not have the authority to overturn the results.
Solomon Cyr, who launched the initial court action, was in court with his lawyer on Wednesday.
His lawyer, Nathan Phillips, says they want a new election to be held as soon as possible because band members are being denied their right to a democratically elected government.
The Appeal Court is scheduled to hear the case on Feb. 10 in Regina.
