Charges against a Vancouver Island man accused of sexual assault in Denver have been dismissed.

The Denver district attorney’s office filed a motion requesting the charges filed against Colby James Messer be dropped and they were dismissed Monday afternoon.

The 30-year-old Port Alberni man was charged last April with six counts of sexual assault following an incident at a Denver hotel.

According to a statement from the district attorney’s office, new information led to a determination that those charges “could no longer be proven beyond a reasonable doubt.”

The inability to prove whether the victim gave consent prompted Denver prosecutors to dismiss the case.
