Pagan’s lawyer Tyler Smith said that Pagan is co-operating with police.

“We’re a little bit concerned, it’s almost like a trial on social media that he’s had to endure, but right now the presumption of innocence applies to him,” Smith told reporters outside the police station.

Smith also said Pagan will not be speaking to media before the trial begins.

The incident happened during the Blue Jays game against the Baltimore Orioles when Jays pinch hitter Melvin Upton Jr. flied out to deep left field.
