The case against the man accused of drunk driving and killing Johnny Gaudreau and his brother Matthew will move forward. Attorneys for Sean Higgins had asked for charges to be thrown out, saying prosecutors had not presented evidence about the brother’s blood-alcohol levels, but the judge denied that request.
