City of Edmonton pleads guilty to charge connected to 2015 death of truck driver

Nearly three years after a city employee was buried under a pile of gravel, the City of Edmonton has pleaded guilty to a charge under Alberta’s Occupational Health and Safety Act.

Stephen Penny died of his injuries in April 2015 after being buried under a pile of gravel that was released from his dump truck. He was behind his truck at the time.

“The city has acknowledged its responsibility in this tragic incident and recognizes the loss felt by his family, friends and colleagues at the city,” the city said in a news release. “Out of respect for Mr. Penny’s family, the city has no further comment.”

The City of Edmonton pleaded guilty to failing to ensure material was properly contained, restrained or protected to eliminate potential danger or injury.

On the night of April 22, 2015, police officers were called to a work site just off 50A Street and 131 Avenue when the incident occurred.

In its news release on Monday, the city said Penny was “behind his truck when street sweepings unloaded from it.”

In an unrelated matter,  a spokesperson for Alberta Occupational Health and Safety confirmed to Global News on Monday that the City of Edmonton has also pleaded guilty to a charge of failing to control vehicle traffic to protect a worker.

That charge stemmed from an incident on June 6, 2015, in which a bin truck driver “suffered a severe injury” when she was pinned against the bin of a waste management truck.

In a media release on Tuesday, the City of Edmonton said Vickie Galet was struck by a loader truck while working at the Waste Management Centre. Galet suffered a life-altering injury to her arm.

“The city has acknowledged its responsibility in this incident and recognizes the loss suffered by Ms. Galet, her family, friends and colleagues at the city,” read a statement from the City of Edmonton.
