The appeal hearing for David and Collet Stephan will be heard March 9.
The southern Alberta couple was found guilty of failing to provide the necessaries of life to their 18-month-old son Ezekiel, who died of bacterial meningitis in 2012. Ezekiel was treated with natural remedies such as garlic, horseradish and hot peppers.
David Stephan was sentenced to four months in jail, while Collet was given three months house arrest. The couple also received two years probation and 240 hours of community service, among other conditions.

Both the Crown and the Stephans filed appeals and both arguments will be heard before the Alberta Court of Appeals in Calgary.
The Stephans are appealing their conviction, claiming the trial judge erred when he refused to allow a former chief medical examiner to give expert advice and by redacting the doctor’s expert report.

The Crown is appealing the Stephans’ sentences, calling them too lenient and failing to reflect the gravity of the crime.

The couple was granted bail in July with the condition that their remaining children see a doctor within two weeks and that they must follow any recommendations made by the doctor.
They remain out on bail pending the hearing.
