WINNIPEG — A Winnipeg man says a rock thrown by a city employee’s lawn mower chipped his windshield while he was driving. Now he wants the city to pay for the damage.
Nathan Zassman said he was driving his car north down Kenaston Boulevard, just south of Corydon Avenue Monday morning. That’s when a rock shot out from the bottom of a city mower, cracking the windshield and damaging the roof.
The employee was mowing a strip of grass on the median in the middle of Kenaston Boulevard.
“I don’t believe they should be doing this type of thing with equipment that has this potential, when there’s, as you see here, wall to wall cars going down the street,” said Zassman.
In cases like these, the city said the driver should file a claim with MPI, who can then pursue the city in an effort to recover the claim.
Drivers can also file a claim directly against the city on its website.
If a claim is filed against the city in either way, an investigation takes place and a decision is made based on the outcome of that investigation.
For now Zassman is on the hook for his $200 deductible. For MPI to get it back negligence on the part of the city employee would have to be proven.
Zassman said the city should re-evaluate mowing the medians, especially where there are rocks and gravel in the grass.
“Perhaps they can look at this and perhaps prevent any serious injury in the future,” said Zassman.
