NASHVILLE, Tenn. – A Ruby Tuesday server is suing the restaurant chain, claiming she is required to do excessive untipped side work, in a federal lawsuit she hopes will become a class action involving thousands of workers nationwide.
The national minimum wage for tipped workers in the U.S. is just $2.13 per hour, a rate that hasn’t changed in 25 years. Workers are allowed to be paid so little because tips are considered part of their wages. Tipped workers can legally do some untipped side work like wiping tables, but it can’t take up more than 20 per cent of their work day.

The Ruby Tuesday case is one of several similar suits targeting some of the country’s largest restaurant chains.
Ruby Tuesday says it will provide a vigorous defence in the appropriate forum.
