OTTAWA – Lawyers for Mohamed Harkat say their client will appeal a court decision that concluded he remains a security threat.

Harkat lawyer Matt Webber says his client is devastated by yesterday’s court decision and broke down in tears.

The federal court’s decision could pave the way for Harkat’s deportation to his native Algeria.

In a separate ruling, Judge Simon Noel upheld the constitutionality of the national security certificate system the government is using to remove Harkat.

It denies the person named full access to the evidence.

Harkat was arrested eight years ago on suspicion of being an al-Qaida sleeper agent.

He is free on bail under strict conditions, and must wear an ankle bracelet that lets authorities track him.

Noel ruled that Harkat did not offer credible testimony to the court.

The federal government had painted Harkat as a calculating terrorist who consistently covered his tracks with lies.

Harkat has denied any involvement with terrorism.
