One of the three people convicted in the killing of Ryan Lane has appealed their first-degree murder conviction.

Sheena Cuthill, 30, was Lane’s ex-girlfriend and the mother of his child.

In April, Cuthill, her husband Tim Rempel and his brother Will Rempel were sentenced to life in prison with no chance of parole for 25 years.

Cuthill’s notice of appeal was filed May 10. She alleges:

  • The trial judge erred in denying her application for exclusion of evidence on the basis of spousal privilege,
  • The trial judge erred in charging the jury on the doctrine of willful blindness,
  • The verdict was unreasonable

Messages between Cuthill and her husband were considered key evidence in the trio’s conviction.

Usually communication between spouses are considered privileged, but Cuthill’s lawyers requests for them to be omitted from evidence were denied.

Cuthill is also disputing the Justice’s decision to convict her on the doctrine of willful blindness. The jury was told that if they believed that Cuthill set in motion the plan to harm Lane, that she should also be found guilty of first-degree murder.

Timothy Rempel has also appealed his conviction but his brother Will has yet to file an appeal.
