Marco Muzzo court case delayed until December

TORONTO — The court case of an alleged drunk driver accused in a crash north of Toronto that killed three children and their grandfather has been adjourned until Dec. 10.

Marco Muzzo, of King Township, Ont., made a brief court appearance via video link on Thursday.

Brian Greenspan, Muzzo’s defence lawyer, said the need to review police disclosure was the reason the bail hearing was put over the last three times.

Daniel Neville-Lake, 9, his brother Harrison, 5, their sister Milly, 2, and the kids’ 65-year-old grandfather died after the mini-van they were in was struck by another vehicle at the intersection of Kipling Avenue and Kirby Road northeast of Kleinburg on the afternoon of Sept. 27.

Two other occupants in the mini-van, the children’s grandmother and great-grandmother, both survived the crash but suffered serious injuries.

Their mother, Jennifer Neville-Lake, said in front of the courthouse Thursday she was told the adjournment was a common move by the defence.

“For us, it’s almost heartening to see him in that jumpsuit and nobody else can get hurt,” said Neville-Lake.

“It’s getting harder and harder … Even physically … I had no idea you could get some physical ailments from stress.”

The Neville-Lake family had previously promised to attend each court session involved in the case.

“We were looking forward once to a long happy life, becoming grandparents, we were talking about having another baby,” she said. “That’s all gone.”
