SASKATOON – The fate of a Saskatoon man is now in the hands of a judge. The Crown and defence presented their closing arguments Thursday in second-degree murder trial of Abraham Eagle.

Eagle is accused of killing Kelly Brian Diehl, 29, in August 2013. Diehl was found in an alley on 5th Avenue North on the evening of Aug. 29 suffering from a stab wound and was declared dead a short time later.

The Crown argued there wasn’t enough evidence that Eagle acted in self-defence or that he was severely intoxicated at the time of Diehl’s death. The Crown also stated that Eagle arrived at a residence an hour after the stabbing in different clothing and admitted to killing someone.

Eagle’s lawyer suggested testimony from some witnesses during the nearly two-week trial was suspect.

The Crown said the witnesses would have no motive to fabricate statements based on surveillance video.
