WATCH: Penticton rapist tells judge he’s lost faith in his defence lawyer

KELOWNA – The final submission in the dangerous offender hearing for an Okanagan man came from the guilty man himself.

David Wesley Bobbitt,39, has admitted to seven criminal offenses stemming from the prolonged and horrific beating and sexual assault of a 22 year old woman inside his Penticton second-hand store in July 2011.

But while he admits to his vile actions, Bobbitt seemingly has no empathy for his victim or remorse for what he did.

On Friday in court, he had the opportunity to perhaps apologize or offer some sort of explanation for his actions, with the judge saying he was “eager” to hear what Bobbitt might have to say.

He responded with an attack on the job performance of his legal aid lawyer.

Bobbitt told the judge: “A lot of the conversations that we had seem to be disregarded. All the evidence I’ve given him seems to have disappeared. There are a lot of things that are not brought out that are very important. I’ve lost faith in my lawyer.”

But the judge contends Bobbitt has been very well represented by defence counsel James Pennington.

And when Bobbitt said he may want a new lawyer, the judge said there wouldn’t be any further adjournments in the sentencing hearing.

After a short recess, the judge again invited Bobbitt to address the court. His reply: “I don’t have anything ready. I’m not feeling well. I haven’t slept in a week.”

The prosecutor calls Bobbitt a psychopathic, sexual sadist and argues he should be declared a dangerous offender and imprisoned indefinitely.

The defence lawyer suggests a prison sentence of 10 to 14 years is more appropriate.

The judge has reserved his decision to a later, unspecified date.
