Lawsuit filed against York officer after teen killed by unmarked car

TORONTO – The family of an 18-year-old woman struck and killed by an unmarked York Regional Police cruiser earlier this year has filed a $2.2 million lawsuit against the officer driving the vehicle and the police service.

Nastasha Carla Abogado was fatally hit on Feb. 12 around 8 p.m. while crossing St. Clair Avenue East, west of Warden Avenue in Toronto.

York police say the incident occurred while the on-duty officer was conducting a mobile surveillance.

Ontario’s Special Investigations Unit have since charged Detective Constable Remo Romano with dangerous driving causing death.

The statement of claim alleges Romano was negligent due to several factors, including travelling at too high a rate of speed and not keeping a proper lookout.

“This was a tragic event and Carla’s family is suffering,” said lawyer John McLeish in a media release on behalf of the Abogado family.

McLeish says the unmarked car was equipped with a data recorder which the family also wants released.

“I’m looking forward to seeing the data on the black box, as it will give details on the police officer’s speed and whether or not he attempted to brake,” McLeish said.
