TORONTO – A California couple fired their 64-year-old live-in nanny but the woman refuses to leave the family’s home.
Ralph Bracamonte and his wife Marcel served Diane Stretton legal papers to quit and leave their home Wednesday but according to police the nanny can legally stay because of a formality.
Turns out, the couple served the nanny with the wrong papers.
“They are telling me it’s now a civil matter and that I have to evict her,” Marcel told CBS News. “So, this lady is welcome inside my house anytime she wants, eat my food anytime she wants.
“I’m now a victim in my own home and it’s completely legal.”
Stretton refused to comment on the situation.
According to the Los Angeles news station, the Bracamontes took her to court but a judge ruled in Stretton’s favour because the couple did not fill out a ‘quit notice’ properly.
“Now, this person is in our house and I have to go to work,” Ralph told CBS. ” My kids are still here, my wife is still here. She towers over my wife, my kids. And I know there is nothing I can do about it.”
Aware of the lengthy eviction process, the Bracamontes said they wanted to share their story as a warning to others to always seek legal advice when dealing with such matters.
