UPDATE: Another mistrial for Calgary psychiatrist

Prosecutors are today considering their next moves after the Calgary trial of forensic psychiatrist Dr. Aubrey Levin, charged with sexual assault, ended in a mistrial for the second time.

The jury was unable to agree on a verdict in the case of two men who were patients of Dr. Levin, and who testified that he touched them improperly during examinations.

The doctor, who gave expert advice in hundreds of court-ordered cases, was sentenced in 2013 to a five-year prison term for assaults on three other patients—a conviction he has appealed.

Last year, 16×9 broadcast an in-depth investigation of earlier criminal charges against Dr Levin. It also looked into his controversial past in South Africa, where he was known in some circles as “Dr. Shock” for his use of shock therapy in treating young homosexual recruits in the military.

Prosecutors say they will await the result of that appeal before deciding if they should go to trial for a third time. They also want to talk to the two men whose case ended in a hung jury, to determine if they want to go ahead.

Dr. Levin is free on bail.
